1. Acceptance of Terms

By accessing or using the HostBuilt platform ("Service"), operated by HostBuilt ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

HostBuilt provides a software platform that enables short-term rental hosts to create direct booking websites, manage property listings, accept guest reservations, process payments, and sync with property management systems. The Service includes the host dashboard, guest-facing booking websites, and associated APIs.

3. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 18 years old to use the Service.
One person or entity may not maintain more than one account without our prior consent.

4. Subscription Plans and Billing

The Service offers paid subscription plans (Starter and Pro) billed monthly or annually via Stripe.
Prices are listed on our pricing page and may change with 30 days' notice.
Subscriptions auto-renew unless cancelled before the end of the current billing period.
Refunds are handled on a case-by-case basis at our discretion.

5. Host Responsibilities

As a host using HostBuilt, you agree to:

Provide accurate property information, including descriptions, photos, pricing, and availability.
Comply with all applicable local, state, and national laws regarding short-term rentals, taxation, and hospitality.
Honour confirmed bookings made through your direct booking website.
Respond to guest inquiries and manage reservations in a timely manner.
Not use the platform for any unlawful, fraudulent, or harmful purposes.

6. Guest Bookings and Payments

Bookings made through HostBuilt-powered websites create a direct agreement between the host and the guest. HostBuilt is not a party to the rental agreement.
Payments are processed through Stripe. HostBuilt may collect a platform fee as disclosed in your subscription plan.
Hosts are responsible for any applicable taxes, including occupancy and sales taxes.

7. Intellectual Property

The HostBuilt platform, including its design, code, and branding, is owned by us and protected by intellectual property laws.
You retain ownership of all content you upload (property photos, descriptions, etc.) and grant us a licence to display it within the Service.
You may not copy, modify, or reverse-engineer any part of the platform.

8. Third-Party Integrations

The Service integrates with third-party platforms including Stripe, Hospitable, Hostaway, Guesty, and Cloudflare. Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for third-party service outages or data handling.

9. Prohibited Uses

You may not use the Service to:

Violate any applicable law or regulation
Post misleading, fraudulent, or deceptive property listings
Interfere with or disrupt the platform's infrastructure
Scrape, harvest, or collect data from other users
Transmit malware, spam, or other harmful content
Resell or redistribute access to the Service without authorization

10. Limitation of Liability

To the maximum extent permitted by law, HostBuilt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, bookings, or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation, nor do we guarantee that the Service will meet your specific requirements.

12. Termination

You may cancel your account at any time from the dashboard.
We may suspend or terminate your account if you violate these Terms or engage in conduct that harms the platform or other users.
Upon termination, your direct booking websites will be taken offline and your data will be retained for a reasonable period to allow recovery, after which it will be deleted.

13. Indemnification

You agree to indemnify and hold harmless HostBuilt, its officers, and employees from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the platform. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
